Agreement to Terms

By creating an account and using the Grantify platform ('the System'), you agree to be bound by these Terms of Service. The System is operated by the State of DOK, Department of Commerce and Development, and is intended for use in connection with state grant programs.

If you do not agree to these terms, you may not create an account or use the System. Certain grant programs may have additional terms or requirements that apply to your participation.

User Accounts

• You must provide accurate and complete information when registering for an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must notify the grants management office immediately if you suspect unauthorized access to your account.
• Each user must have their own account. Sharing accounts is prohibited.
• The State reserves the right to deactivate accounts that are inactive, fraudulent, or in violation of these terms.

Acceptable Use

When using the System, you agree to:

• Use the platform only for its intended purpose of managing grant-related activities with the State
• Submit truthful and accurate information in all applications, reports, and correspondence
• Comply with all applicable state and federal laws, regulations, and grant program requirements
• Respect the confidentiality of information belonging to other users or organizations
• Refrain from attempting to access data or system functionality beyond your authorized role

You must not:

• Submit false, misleading, or fraudulent information
• Attempt to gain unauthorized access to the System or other users' accounts
• Upload malicious software, viruses, or harmful content
• Use automated tools (bots, scrapers) to interact with the System
• Interfere with or disrupt the System's operation or security

Grant Applications and Submissions

• Submitting an application does not guarantee funding. All awards are subject to the review and approval processes established by the administering agency.
• You certify that all information submitted through the System is true and accurate to the best of your knowledge.
• Applications submitted after posted deadlines may not be considered. The System timestamp will serve as the official record of submission time.
• Submitted materials become part of the official state record and may be subject to public disclosure under applicable law.

Grant Awards and Compliance

• If you receive a grant award, you are bound by the terms and conditions of the award agreement, applicable state and federal regulations, and any program-specific requirements.
• You must submit all required reports and financial documentation by the specified deadlines.
• Failure to comply with award terms may result in suspension, termination, or recoupment of grant funds.
• The State reserves the right to audit grant-funded activities and expenditures at any time.

Intellectual Property

The Grantify platform, including its design, functionality, and content (excluding user-submitted data), is the property of the State of DOK. You may not reproduce, distribute, or create derivative works based on the System without written authorization.

You retain ownership of the content you submit through the System, subject to the State's right to use such content for grant administration, oversight, and reporting purposes.

Disclaimers and Limitation of Liability

The System is provided on an 'as is' and 'as available' basis. While the State strives to maintain system availability and data integrity, we do not guarantee uninterrupted or error-free operation.

The State of DOK shall not be liable for any indirect, incidental, or consequential damages arising from your use of the System, including but not limited to loss of data, missed deadlines due to system unavailability, or errors in submitted information.

Users are responsible for maintaining their own backups of documents submitted through the System.

Account Termination

The State may suspend or terminate your account at any time for violation of these Terms of Service, suspected fraud, or as otherwise required by law. You may request account deactivation by contacting the grants management office.

Upon account termination, your access to the System will be revoked. Data associated with active or closed grant awards will be retained in accordance with applicable records retention schedules.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of DOK, without regard to conflict of law principles. Any disputes arising from or relating to these terms or your use of the System shall be subject to the exclusive jurisdiction of the courts of the State of DOK.

Changes to Terms

The State may update these Terms of Service at any time. Material changes will be communicated to registered users through the platform's notification system. Continued use of the System after changes are posted constitutes acceptance of the updated terms.
